Terms of Service

1. Acceptance of Terms

By accessing or using Splocket Pulse ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users including administrators, managers, schedulers, and workers.

2. Description of Service

Splocket Pulse is a cloud-based workforce management platform providing scheduling, real-time adherence monitoring, demand forecasting, anomaly detection, and workforce analytics. The Service is part of the Splocket product suite.

3. Account Registration

Organizations must register for an account to use the Service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring all users within your workspace comply with these terms
• Providing accurate and current information during registration

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload false, misleading, or fraudulent workforce data
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or attempt to extract the source code
• Use the Service to manage workers in violation of applicable labor laws

5. AI Features

Splocket Pulse includes AI-powered features (schedule generation, demand forecasting, anomaly interpretation, executive summaries) powered by Claude (Anthropic). These features are provided as tools to assist decision-making. You acknowledge that:

• AI outputs are recommendations, not directives
• You retain full responsibility for all workforce decisions made using the platform
• AI features may occasionally produce inaccurate or incomplete outputs
• Splocket is not liable for decisions made based on AI-generated recommendations

6. Subscription and Payment

Access to the Service requires a paid subscription after any applicable free trial period. Subscriptions are billed per worker per month. You authorize us to charge your payment method on a recurring basis. Failure to pay may result in suspension of your account.

We reserve the right to modify pricing with 30 days notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7. Data Ownership

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service. We do not use your workforce data to train AI models or share it with third parties except as described in our Privacy Policy.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We are not liable for any loss or damage caused by service outages, maintenance windows, or factors beyond our control.

9. Termination

Either party may terminate the Service relationship at any time. Upon termination, your access to the Service will cease. You may request an export of your data within 30 days of termination. After 30 days, we may delete your data permanently.

10. Limitation of Liability

To the maximum extent permitted by law, Splocket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification with at least 14 days notice. Continued use of the Service after changes take effect constitutes acceptance.
